The Resort is currently being operated and managed on an unbranded basis. However, upon the construction and completion of certain facilities and amenities (including, but not limited to, the spa and the beachfront restaurant bar and grill), and the satisfaction of certain other conditions, it is anticipated, although it is not guaranteed, that the Resort will be operated and managed under the RockResort brand. Until such time, if at all, the Resort shall not be identified as a RockResort and shall not have the right to use the RockResort Trademarks.
